INFORMATION ON THE PROCESSING OF PERSONAL DATA PURSUANT TO ARTICLE 13 OF REGULATION (EU) 2016/679
This Privacy Policy is intended to describe the management of this site, with reference to the processing of personal data of users/visitors who consult it. This information is also provided pursuant to art. 13 of Legislative Decree no. 196/03 - Code for the protection of personal data - to those who connect to the company website of Sundar Italia SRL and use its web services from the address www.sundaritalia.com. The information is provided only for the above-mentioned sites and not for other websites that may be consulted by the user through specific links.
The site www.sundaritalia.com is owned by Sundar Italia SRL, managed by Sundar Italia SRL which guarantees the respect of the legislation on the protection of personal data (Legislative Decree 196/03). Users/visitors must read this Privacy Policy carefully before submitting any personal information and/or filling in any electronic form on the site itself. The Owner can be contacted at the address: info@sundaritalia.com. The Data Controller has not, for the time being, formally designated a Data Protection Officer pursuant to art. 37 of EU Regulation 2016/679, as it does not fall within the cases of obligation.
1. The Personal Data being processed
Following navigation of the Site, we inform you that Sundar Italia SRL will process your Personal Data, which may consist of an identifier such as your name, an identification number, an online identifier or one or more characteristic elements of your physical, economic, cultural or social identity capable of making the person concerned identified or identifiable.
Other Personal Data freely provided by you in the contact request forms (for example, to request information and quotes) may be processed. Any sensitive data, as per Art. 9.1 Reg. 2016/679/EU, should not be processed unless explicit consent is given by the data subject.
a. Navigation data
The computer systems and software procedures used to operate the Site acquire, during their normal operation, some Personal Data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of the computers used by users who connect to the Website, URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the operating system and the user's computer environment. These data are used for the sole purpose of obtaining anonymous statistical information on the use of the Site and to check its correct functioning, to identify anomalies and/or abuses, and are deleted immediately after processing. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the site or third parties: except for this possibility, the data on web contacts do not persist for more than seven days.
b. Data provided voluntarily by the data subject
We may process personal and/or contact data such as name, surname, email and telephone. If you communicate to Sundar Italia SRL Personal Data of third parties, you must guarantee - assuming all responsibility - that this particular hypothesis of treatment is based on a suitable legal basis pursuant to art. 6 of the Regulation, which legitimizes the communication to Sundar Italia SRL and the related processing of the information in question.
2. Purpose of processing
The data processing we intend to carry out may have the following purposes:
a. Enable the provision of the Services you have requested such as:
sending quotes;
subscription to the email newsletter;
sharing of content on the site;
generic request for information;
collection and analysis of curricula vitae for collaboration or affiliation purposes;
b. respond to requests for assistance or information;
c. fulfil any legal, accounting and fiscal obligations;
d. assert or defend rights in court, in case of abuse in the use of the Site and/or our Services or for contractual or non-contractual disputes;
3. Basis of legitimacy and obligatory or optional nature of the treatment
The legal basis for the processing of Personal Data for the purposes referred to in section 3(a-b) is art. 6.1.b) of the Regulation as the processing is necessary for the provision of the Services or to respond to requests from the data subject. The provision of Personal Data for these purposes is optional, but failure to provide it would make it impossible to activate the Services provided by the Site.
For processing operations that fall within the statutory purposes of Sundar Italia SRL, included among those referred to at letter 3(a), data may be processed by members or parties who are in regular contact with Sundar Italia SRL. If you have purchased services or goods from Sundar Italia SRL, your data may be processed for the purpose of direct mailing of advertising material regarding products or services of Sundar Italia SRL similar to those purchased by you, without your consent. The processing of your data for such purposes is the legitimate interest referred to in art. 6.1.f) of the Regulations and art. 130 paragraph 4 of Legislative Decree no. 196/2003. In any case, pursuant to art. 21 of the Regulations, you have the possibility to object to such processing at any time, either initially or on the occasion of subsequent communications, easily and free of charge also by writing to the Data Controller at the addresses indicated above, as well as to obtain immediate feedback confirming the interruption of such processing (art. 15 of the Regulations).
The purpose referred to in section 3(c) represents a processing of Personal Data carried out pursuant to art. 6.1.c) of the Regulation, in order to comply with a legal obligation. Once the Personal Data has been provided, the processing is indeed necessary to fulfil a legal obligation to which Sundar Italia SRL is subject. The processing for the purposes referred to in section 3(d) would be carried out pursuant to art. 6.1.f) of the Regulation.
4. Recipients of Personal Data
Your Personal Data may be shared, for the purposes set out in section 3 above, with:
- a. subjects who typically act as data processors pursuant to art. 28 of the Regulation, namely: i) persons, companies or professional firms that provide assistance and advice to Sundar Italia SRL in accounting, administrative, legal, tax, financial and debt collection relating to the provision of services; ii) subjects with whom it is necessary to interact to provide the Services; iii) or subjects delegated to carry out technical maintenance (including maintenance of network equipment and electronic communication networks); (collectively "Recipients").
- b. subjects, entities or authorities, independent data controllers, to whom it is mandatory to communicate your Personal Data by virtue of provisions of law or orders of the authorities;
- c. persons authorized by Sundar Italia SRL to the processing of Personal Data ex art. 29 of the Regulation necessary to carry out activities closely related to the provision of services, who are committed to confidentiality or have an appropriate legal obligation of confidentiality (eg employees of Sundar Italia SRL)
5. Data retention
Personal Data processed for the purposes set out in section 3(a-d) will be kept for the time strictly necessary to achieve those same purposes in accordance with the principles of minimization and limitation of storage pursuant to art. 5.1.e) of the Regulation. Further information regarding the data retention period and the criteria used to determine this period may be requested by writing to the Data Controller.
6. Rights of the interested parties
Pursuant to articles 15 and following of the Regulation, you have the right to request at any time, access to your Personal Data, the rectification or deletion of the same, the limitation of processing in the cases provided for by art. 18 of the Regulation, to obtain in a structured, commonly used and machine-readable format the data concerning you, in the cases provided for by art. 20 of the Regulation. At any time, you may revoke the consent given, pursuant to art. 7 of the Regulations; you may lodge a complaint with the competent supervisory authority (Garante per la Protezione dei Dati Personali WWW.GARANTEPRIVACY.IT) pursuant to art. 77 of the Regulations, if you believe that the processing of your data is contrary to the regulations in force.
You may formulate a request to object to the processing of your data pursuant to Article 21 of the Regulation in which you must give evidence of the reasons justifying the objection: the Owner reserves the right to evaluate the request, which would not be accepted in case of the existence of compelling legitimate reasons to proceed with the processing that prevail over your interests, rights and freedoms. Requests should be addressed in writing to the Data Controller.
7. Changes
Sundar Italia SRL reserves the right to modify or simply update the content, in part or in full, also due to changes in the applicable legislation of this privacy policy.
8. Cookies and online trackers
This cookie policy refers exclusively to the site and must be understood as an integral part of the Privacy Policy of the same.
Cookies are small text files that sites you visit send and store on your computer or mobile device, and then transmit them back to the same sites the next time you visit. It is thanks to cookies that a site remembers the user's actions and preferences (such as, for example, login data, the language chosen, font size, other display settings, etc.) so that they do not have to be indicated again when the user returns to that site or navigates from one page to another. Cookies, therefore, are used to perform computer authentication, session monitoring and storage of information regarding the activities of users who access a site and may also contain a unique identification code that allows you to keep track of user navigation within the site for statistical or advertising purposes. Failure to consent to the other indicated third party cookies will not affect the operation of the Site; however, since these types of cookies are sent exclusively by third parties, and since the Site manager cannot control the sending of these cookies to the user's terminal, the related objection can only be exercised by accessing the consent forms provided by the aforementioned third parties, if any, or through the settings on the user's browser. As regards the cookies directly sent by the Site manager, in addition to the procedure made available on this page, the user may block or delete (in whole or in part) the cookies also through the specific functions of his or her browser (in this regard, see above).
The choices made by the user with reference to the Site's cookies will in turn be recorded in a special technical cookie, with the characteristics indicated in the relevant cookie table.
